By accessing or using the Bad Ash Cigar Company LLC website located at badashtobacco.com ("Site"), placing an order, or otherwise engaging with our services, you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in full, you must not use this Site or purchase any products.

These Terms constitute a legally binding agreement between you and Bad Ash Cigar Company LLC ("Company," "we," "us," or "our"), a limited liability company. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Site following any changes constitutes your acceptance of the revised Terms. The effective date at the top of this page reflects the most recent revision.

All tobacco and cigar products sold by Bad Ash Cigar Company LLC are restricted to individuals who are 21 years of age or older, in compliance with the Family Smoking Prevention and Tobacco Control Act and applicable state laws.

By placing an order, you represent and warrant that:

• You are at least 21 years of age;
• You are legally permitted to purchase tobacco products in your state and jurisdiction;
• The information you provide during checkout, including your name, date of birth, and shipping address, is accurate and truthful;
• You will not purchase products on behalf of a minor or allow a minor to receive delivery of any order.

We reserve the right to require age verification at any point during the purchase process. Orders may be canceled and refunded if we are unable to verify your age. All deliveries require an adult signature upon receipt. Carriers are instructed not to leave packages unattended or deliver to minors.

Bad Ash Cigar Company LLC exclusively sells premium hand-rolled cigars and related cigar accessories. We do not sell cigarettes, e-cigarettes, vaping products, smokeless tobacco, or flavored tobacco products subject to FDA marketing denial orders.

We comply with all applicable FDA regulations governing premium cigar products, including but not limited to:

• Surgeon General warning labeling requirements on all product listings and packaging;
• Federal prohibition on sales to individuals under 21;
• Compliance with the Prevent All Cigarette Trafficking (PACT) Act for applicable shipments;
• Applicable state excise tax collection and reporting obligations.

We reserve the right to restrict or refuse sales to certain states or jurisdictions where local regulations prohibit or materially restrict the shipment or sale of cigar products. A current list of states where we cannot ship is available on our shipping information page.

All orders placed through our Site are subject to acceptance by Bad Ash Cigar Company LLC. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, suspected fraud, or failure to verify age.

Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Applicable state and local taxes, including tobacco excise taxes, will be calculated and added at checkout where required.

Payment: We accept major credit and debit cards (Visa, Mastercard, Discover, American Express) processed through a PCI-DSS compliant payment gateway. By submitting payment, you authorize us to charge your card for the total order amount including applicable taxes and shipping fees. You represent that you are the authorized cardholder or have permission to use the payment method provided.

Chargebacks: If you believe there is an error on your order or billing, please contact us directly before initiating a chargeback with your card issuer. Unauthorized chargebacks on valid, fulfilled orders may result in account suspension and collection action.

We ship within the United States to states where the sale and shipment of cigar products is permitted. All shipments are sent via a carrier capable of verifying recipient age upon delivery.

• Adult Signature Required: All orders require an adult signature (21+) upon delivery. No orders will be left unattended or delivered to a minor.
• Shipping Address: You are responsible for providing a complete and accurate shipping address. We are not responsible for delays or non-delivery due to incorrect address information.
• Estimated Times: Shipping timeframes are estimates only and are not guaranteed. Delays may occur due to carrier volume, weather, or other factors outside our control.
• Risk of Loss: Title and risk of loss for products pass to you upon delivery to the carrier.
• Restricted States: We are unable to ship to states or localities that prohibit the shipment of tobacco products. Orders placed from restricted areas will be canceled and refunded.

In compliance with the PACT Act, we report applicable shipments to the ATF and relevant state tax authorities and collect state tobacco excise taxes where required.

Due to the perishable and regulated nature of cigar products, all sales are final unless the product arrived damaged, defective, or materially different from what was ordered.

Eligible for Refund or Replacement:

• Products that arrived visibly damaged due to shipping;
• Products that were incorrect (wrong item shipped);
• Orders that were never delivered and confirmed lost by the carrier.

Not Eligible for Refund:

• Products that have been opened, smoked, or partially consumed;
• Dissatisfaction with taste, flavor, or personal preference;
• Orders delayed by carrier or weather events;
• Orders placed in error by the customer.

To request a refund or replacement, contact us within 7 days of delivery with your order number and photographic evidence of the issue. Approved refunds will be processed to the original payment method within 5–10 business days.

Order Cancellations: Orders may be canceled within 2 hours of placement if they have not yet been processed or shipped. Contact us immediately at the information listed below.

Our products contain tobacco, a product known to the State of California to cause cancer, birth defects, or other reproductive harm.

By purchasing from Bad Ash Cigar Company LLC, you acknowledge that you have read and understand these health warnings. You accept full personal responsibility for any health risks associated with the use of tobacco products.

We do not make any health, wellness, or medicinal claims about our products. Nothing on this Site is intended to constitute medical advice.

You may not use this Site or our products for any of the following:

• Purchasing on behalf of or for delivery to a minor;
• Reselling products without an appropriate tobacco retail or wholesale license;
• Providing false age, identity, or billing information;
• Using fraudulent, stolen, or unauthorized payment methods;
• Circumventing age-verification systems or delivery signature requirements;
• Any unlawful purpose or activity in violation of federal, state, or local law;
• Scraping, harvesting, or reproducing Site content without written permission;

Violation of these prohibited uses may result in immediate termination of your account, cancellation of orders, and referral to appropriate law enforcement.

All content on this Site — including but not limited to text, graphics, logos, images, product photography, brand marks, cigar blend names, packaging designs, and the "Bad Ash Cigar Company" and "Bad Ash Tobacco Co." names and logos — is the exclusive property of Bad Ash Cigar Company LLC and is protected by U.S. and international intellectual property laws including copyright, trademark, and trade dress protections.

You are granted a limited, non-exclusive, non-transferable license to access and view Site content solely for personal, non-commercial use in connection with evaluating or purchasing our products. This license does not include the right to:

You expressly acknowledge and agree that tobacco use carries well-documented health risks, that you have been fully advised of these risks through mandatory Surgeon General warnings, and that you assume full personal responsibility for your decision to purchase and use tobacco products.

These Terms and any disputes arising from your use of this Site or purchase of our products shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Illinois, and you hereby irrevocably consent to personal jurisdiction and venue in such courts.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or prevent irreparable harm.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Bad Ash Cigar Company LLC with respect to your use of this Site and supersede all prior or contemporaneous communications and proposals.

Bad Ash Cigar Company LLC offers wholesale and private-label cigar products through Farm House Blends, our manufacturing and fulfillment division. Wholesale customers are subject to additional terms, licensing requirements, and minimum order quantities outlined in a separate Wholesale Agreement.

All wholesale purchasers must:

• Hold a valid tobacco retail or wholesale license in their state of operation;
• Provide current business licensing and resale documentation upon request;
• Agree to comply with all applicable tobacco laws in their jurisdiction, including age-verification and sale restrictions;
• Not resell products to minors or in states where such sales are prohibited.

Bad Ash Cigar Company LLC reserves the right to terminate wholesale relationships and cancel pending orders for any account found to be in violation of applicable laws or our wholesale terms. Wholesale pricing and minimum quantities are subject to change with reasonable notice.

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any security breach.

We reserve the right to suspend or terminate accounts that:

• Provide false or misleading registration information;
• Are used to facilitate fraudulent transactions;
• Belong to individuals who have been found to misrepresent their age;
• Are associated with excessive chargebacks or disputed transactions;

We aim to respond to all inquiries within 1–2 business days. For billing disputes, please allow us the opportunity to resolve the issue directly before initiating a chargeback with your financial institution. Many disputes can be resolved quickly with direct communication.

Informal Resolution: Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute informally by contacting the other party and describing the dispute in reasonable detail. We will make good-faith efforts to resolve any complaint within 14 business days of receipt.

Formal Dispute Process: If informal resolution fails after 30 days, either party may pursue their legal rights as outlined in Section 12 (Governing Law). Both parties agree to attempt non-binding mediation before initiating litigation, with mediation costs split equally.
