By accessing or using the Bad Ash Cigar Company LLC website located at badashtobacco.com ("Site"), placing an order, or otherwise engaging with our services, you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in full, you must not use this Site or purchase any products.

These Terms constitute a legally binding agreement between you and Bad Ash Cigar Company LLC ("Company," "we," "us," or "our"), a limited liability company. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Site following any changes constitutes your acceptance of the revised Terms. The effective date at the top of this page reflects the most recent revision.

All tobacco and cigar products sold by Bad Ash Cigar Company LLC are restricted to individuals who are 21 years of age or older, in compliance with the Family Smoking Prevention and Tobacco Control Act and applicable state laws.

By placing an order, you represent and warrant that:

• You are at least 21 years of age;
• You are legally permitted to purchase tobacco products in your state and jurisdiction;
• The information you provide during checkout, including your name, date of birth, and shipping address, is accurate and truthful;
• You will not purchase products on behalf of a minor or allow a minor to receive delivery of any order.

We reserve the right to require age verification at any point during the purchase process. Orders may be canceled if we are unable to verify your age prior to processing. All deliveries require an adult signature upon receipt. Carriers are instructed not to leave packages unattended or deliver to minors.

Bad Ash Cigar Company LLC exclusively sells premium hand-rolled cigars and related cigar accessories. We do not sell cigarettes, e-cigarettes, vaping products, smokeless tobacco, or flavored tobacco products subject to FDA marketing denial orders.

We comply with all applicable FDA regulations governing premium cigar products, including but not limited to:

• Surgeon General warning labeling requirements on all product listings and packaging;
• Federal prohibition on sales to individuals under 21;
• Compliance with the Prevent All Cigarette Trafficking (PACT) Act for applicable shipments;
• Applicable state excise tax collection and reporting obligations.

We reserve the right to restrict or refuse sales to certain states or jurisdictions where local regulations prohibit or materially restrict the shipment or sale of cigar products. A current list of states where we cannot ship is available on our shipping information page.

All orders placed through our Site are subject to acceptance by Bad Ash Cigar Company LLC. We reserve the right to refuse or cancel any order prior to processing for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, suspected fraud, or failure to verify age. Once an order has entered processing, it cannot be canceled by the customer — please review Section 6 for full details.

Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Applicable state and local taxes, including tobacco excise taxes, will be calculated and added at checkout where required.

Payment: We accept major credit and debit cards (Visa, Mastercard, Discover, American Express) processed through a PCI-DSS compliant payment gateway. By submitting payment, you authorize us to charge your card for the total order amount including applicable taxes and shipping fees. You represent that you are the authorized cardholder or have permission to use the payment method provided.

Chargebacks: If you believe there is an error on your order or billing, please contact us directly before initiating a chargeback with your card issuer. Because all sales are final once an order has been processed (see Section 6), unauthorized chargebacks on valid, fulfilled orders will be contested and may result in account suspension and collection action.

Bad Ash Cigar Company LLC ships within the United States to states where the sale and shipment of cigar products is permitted. All orders are fulfilled using standard domestic shipping, and delivery will follow standard domestic shipping timeframes as determined by our carrier. All shipments are sent via a carrier capable of verifying recipient age upon delivery.

• Shipping Method: All orders are shipped via standard domestic shipping. Expedited, overnight, and international shipping options are not currently offered.
• Delivery Timeframes: Orders will arrive within standard domestic shipping times as set by the carrier. These timeframes are estimates only and are not guaranteed. Delays may occur due to carrier volume, weather, holidays, or other factors outside our control.
• Adult Signature Required: All orders require an adult signature (21+) upon delivery. No orders will be left unattended or delivered to a minor.
• Shipping Address: You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, non-delivery, or returned packages resulting from incorrect address information.
• Risk of Loss: Title and risk of loss for products pass to you upon delivery to the carrier.
• Restricted States: We are unable to ship to states or localities that prohibit the shipment of tobacco products. Orders placed from restricted areas will be canceled prior to processing.

In compliance with the PACT Act, we report applicable shipments to the ATF and relevant state tax authorities and collect state tobacco excise taxes where required.

No Cancellations After Processing: Orders cannot be canceled once they have entered our processing queue. Because our fulfillment begins promptly after an order is placed, we are unable to accommodate cancellation requests after processing has started, regardless of the reason. Please review your order carefully — including products, quantities, billing details, and shipping address — before submitting payment.

No Refunds After Processing: All sales are final. Once an order has been processed, no refunds will be issued under any circumstances, including but not limited to:

• Change of mind or buyer's remorse;
• Dissatisfaction with taste, flavor, draw, burn, or personal preference;
• Delays caused by the shipping carrier, weather, or other factors outside our control;
• Orders placed in error by the customer (wrong product, quantity, or address);
• Products that have been opened, smoked, or partially consumed;
• Failure to be present for delivery or to complete the adult-signature requirement.

Damaged or Incorrect Shipments: In the rare event that your order arrives visibly damaged due to shipping or contains an incorrect item (wrong product shipped), please contact us within 7 days of delivery with your order number and clear photographic evidence of the issue. These situations will be reviewed on a case-by-case basis at the sole discretion of Bad Ash Cigar Company LLC and do not constitute a general right to refund.

Our products contain tobacco, a product known to the State of California to cause cancer, birth defects, or other reproductive harm.

By purchasing from Bad Ash Cigar Company LLC, you acknowledge that you have read and understand these health warnings. You accept full personal responsibility for any health risks associated with the use of tobacco products.

We do not make any health, wellness, or medicinal claims about our products. Nothing on this Site is intended to constitute medical advice.

You may not use this Site or our products for any of the following:

• Purchasing on behalf of or for delivery to a minor;
• Reselling products without an appropriate tobacco retail or wholesale license;
• Providing false age, identity, or billing information;
• Using fraudulent, stolen, or unauthorized payment methods;
• Circumventing age-verification systems or delivery signature requirements;
• Any unlawful purpose or activity in violation of federal, state, or local law;
• Scraping, harvesting, or reproducing Site content without written permission;

Violation of these prohibited uses may result in immediate termination of your account, cancellation of orders, and referral to appropriate law enforcement.

All content on this Site — including but not limited to text, graphics, logos, images, product photography, brand marks, cigar blend names, packaging designs, and the "Bad Ash Cigar Company" and "Bad Ash Tobacco Co." names and logos — is the exclusive property of Bad Ash Cigar Company LLC and is protected by U.S. and international intellectual property laws including copyright, trademark, and trade dress protections.

You are granted a limited, non-exclusive, non-transferable license to access and view Site content solely for personal, non-commercial use in connection with evaluating or purchasing our products. This license does not include the right to:
